By accessing or using the Mind Monarch Services LLC website (the “Site”) or booking any services through the Site, you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, do not use this Site or our services.

1. Nature of Services & No Legal/Therapy Advice

Mind Monarch provides coaching and mediation services focused on education, support, and strategy in high‑conflict and family‑related situations. Nothing on this Site or in our services is legal advice, therapy, or medical advice.

Mind Monarch Services LLC and its coaches are not acting as attorneys, therapists, or medical providers.
Using this Site or our services does not create an attorney‑client, therapist‑client, or doctor‑patient relationship.
You are responsible for consulting your own licensed attorney, therapist, or healthcare provider for legal, mental‑health, or medical issues.

Your use of this Site and services is voluntary and at your own risk.

2. No Guarantees of Outcomes

Mind Monarch cannot and does not guarantee any particular result, including but not limited to:

Court outcomes or rulings
Custody or visitation results
Financial settlements or property outcomes
Changes in another person’s behavior (e.g., co‑parent, ex‑partner, family member)

Any examples or testimonials are illustrative only and do not guarantee that you will achieve the same or similar results.

3. Eligibility & Appropriate Use

You may use this Site only if:

You are at least 18 years old and legally able to enter into contracts; and
You agree to use the Site and services only for lawful purposes and in accordance with these Terms.

You agree not to misuse the Site, attempt to gain unauthorized access, or use it to harass, threaten, or harm others.

4. Booking, Payment, and Cancellation Summary

This Site allows you to book coaching, resilience coaching, day‑of‑court support, or mediation services online. All bookings are subject to the full Refund and Cancellation Policy.

Prepayment and payment in full: All services must be paid in full at the time of booking. Session and package prices are listed on the Services/Booking page. Fees are earned upon booking and are generally non‑refundable, except where required by law.
Non‑refundable fees: Payment‑processor and transaction fees (for example, credit‑card or platform fees) are non‑refundable in all cases.
Cancellations and rescheduling: Because your time is reserved exclusively for you, cancellations and rescheduling requests do not entitle you to a refund. Any reschedule or credit that is offered is a courtesy and is made solely at Mind Monarch’s discretion and does not create a right to future exceptions.
Written notice: All cancellation or rescheduling requests must be made in writing (email) and are not effective until acknowledged as received.

5. Confidentiality & Safety Online

Sessions are intended to be private and confidential, subject to legal exceptions (such as mandatory reporting of suspected abuse or imminent risk of serious harm).

To help protect your privacy:

Use a secure device and a private location for sessions and communications.
Avoid conducting sessions in public spaces or on shared devices where others can overhear or access your information.
Do not record sessions (audio, video, or screenshots) without prior written consent from Mind Monarch Services and, where applicable, from all other participants.

Mind Monarch Services LLC may disclose information if required by law, such as in response to a court order or where there is a reasonable belief of imminent risk of serious harm.

6. SMS / Phone Number Privacy and Consent

If you provide a mobile number, you may receive SMS/text messages related to:

Appointment reminders and confirmations
Service‑related updates or check‑ins you have opted in to receive
Customer support communications

By providing your number, you consent to receive such messages. Message and data rates may apply. Message frequency may vary.

Opt‑out: Reply STOP to unsubscribe.
Help: Reply HELP for assistance.
Mind Monarch Services LLC will not sell or share your mobile number with third parties for their own marketing purposes.
Your number is used only as described in these Terms and our privacy practices.

7. Intellectual Property

All content on this Site, including text, logos, graphics, and materials provided in connection with services, is owned by or licensed to Mind Monarch Services LLC and is protected by applicable intellectual‑property laws.

You may not reproduce, distribute, sell, modify, or create derivative works from any content or materials without Mind Monarch’s prior written consent.

Limited personal use (viewing, downloading for your own reference) is permitted, so long as you do not remove copyright notices or use the materials to create competing services.

8. Limitation of Liability

The Site and all services offered by Mind Monarch are provided “as is” and “as available” and at your own risk.

To the maximum extent permitted by law:

Mind Monarch Services LLC and its owners, coaches, contractors, and staff will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or business opportunities arising out of or related to your use of this Site or services.
Any liability of Mind Monarch Services LLC and its coaches in connection with services provided to you is limited as set out in the signed agreements you enter into with Mind Monarch, which govern the relationship and control in the event of any inconsistency with these Terms.

Nothing in these Terms creates any fiduciary duty. The relationship between you and Mind Monarch is limited to that expressly described in the applicable signed agreements.

9. No Emergency or Crisis Services

Mind Monarch does not provide emergency, crisis, or on‑call services.

If you are in crisis or believe you or someone else may be in danger, call 911 (or your local emergency number), contact a crisis hotline, or seek help from local emergency or mental‑health services immediately.

10. Third‑Party Links

The Site may contain links to third‑party websites or resources. These are provided for convenience only.

Mind Monarch does not control and is not responsible for the content, policies, or practices of third‑party sites and does not endorse them. Your use of third‑party sites is at your own risk.

11. Changes to These Terms

Mind Monarch may update these Terms from time to time. When changes are made, the “Last Updated” date at the top of this page will be revised.

Your continued use of the Site after any changes become effective constitutes your acceptance of the updated Terms. If you do not agree, you must stop using the Site and services.

12. Governing Law & Jurisdiction

These Terms and any dispute arising out of or related to your use of this Site or Mind Monarch services are governed by the laws of the State of California, without regard to conflict‑of‑law principles.

You agree that any claim or dispute will be brought exclusively in the state or federal courts located in Alameda County, California, USA, and you consent to personal jurisdiction in those courts.
